This Privacy Policy describes how KAIN New York LLC, doing business as Nivelle.nyc ("Nivelle", "we", "us", "our"), collects, uses, and shares personal information when you visit nivelle.nyc or account.nivelle.nyc (together, the "Site"), create an account, request trade or private label pricing, place an order, or otherwise interact with us. Nivelle is a business-to-business fine jewelry supplier headquartered in New York. Most of our customers are businesses, but this policy applies to any individual whose information we handle.

Information we collect

Information you give us. When you create an account, apply for a trade or wholesale account, request a private label quote, place an order, book an appointment, subscribe to our emails, or contact us, we collect the information you provide, which may include your name, company name, job title, business address, billing and shipping addresses, email address, phone number, resale or tax identification details, order details, and the content of your messages. Payment card details are entered directly with our payment processors and are not stored on our systems.

Information collected automatically. When you use the Site we and our service providers automatically collect device and usage information: IP address, browser type, time zone, device identifiers, the pages and products you view, the site or search terms that referred you, and how you interact with the Site. We collect this using cookies, log files, pixels, and similar technologies. You can control cookies through your browser settings; disabling cookies may limit some Site features. Information from third parties. We may receive information about you from business partners, trade shows and events you register for, payment and fraud prevention providers, and publicly available business sources, in order to verify trade accounts and prevent fraud.

How we use your information

We use personal information to: process and fulfil orders, including manufacturing, quality control, insured shipping, invoicing, and order confirmations; open and manage trade, wholesale, and private label accounts and apply the pricing you are eligible for; communicate with you about orders, quotes, appointments, and support requests; screen orders for risk and fraud; send marketing emails and SMS where you have signed up or where permitted by law, with the option to unsubscribe at any time; improve and secure the Site and our products; and comply with legal, tax, and accounting obligations.

How we share your information

We share personal information with service providers who help us run the business, only as needed for the services they perform. These include Shopify Inc., which hosts our store and processes checkout (see Shopify's Privacy Policy); payment processors such as Shopify Payments and PayPal; our inventory and order management software; email and SMS marketing platforms; wishlist, forms, and customer account apps installed on the Site; analytics and advertising providers such as Google; shipping carriers and insurers; our manufacturing partners, who receive only the specifications needed to produce an order and not your customer data; and accountants, legal advisers, and other professional advisers.

We may also disclose information to comply with applicable laws, respond to a subpoena, search warrant, or other lawful request, or to protect our rights. If Nivelle is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We do not sell your personal information.

Advertising and analytics

We use analytics tools to understand how visitors use the Site, including Shopify's built-in analytics, Google Analytics, and the onsite tracking of our email marketing platform (Klaviyo). You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout. We may also use targeted advertising and product listing services (including Google Merchant Center) that use cookies and pixels to show you relevant ads. You can opt out of certain interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info.

Google Analytics is connected to the Site through Shopify's Google & YouTube channel and receives page views, product views, cart, checkout, and purchase events, together with the traffic source that brought you to the Site. We also use Google Search Console, which reports only aggregated Google Search data and does not identify individual visitors. Where your region requires consent, these analytics and advertising tools only run after you accept cookies through the cookie banner on the Site.

If you hold a trade account with us, or you interact with our emails or forms, our systems may associate your browsing activity on the Site, such as the pages and products you view, the collections and curated selections you open, and the times of your visits, with your account or email address. We use this information to prepare relevant selections, follow up on your interests, and serve our trade customers. We do not sell it. You can ask us to stop this association or to delete this data at any time using the contact details below.

Marketing communications

If you sign up for our newsletter or trade updates, we will email you about new collections, private label programs, trade show appointments, and offers. You can unsubscribe using the link in any email or by contacting us. If you opt in to SMS, message and data rates may apply and you can reply STOP at any time.

Data retention

We keep order, invoice, and account records for as long as needed to serve you, maintain warranty and repair history, and meet legal, tax, and accounting requirements, unless you ask us to delete them and we are not required to retain them.

Your rights

Depending on where you live, you may have the right to access, correct, or delete the personal information we hold about you, to receive a copy of it, to object to or restrict certain processing, and to withdraw consent. New York and California residents may have additional rights under state law, including the right to know what personal information we collect and to opt out of the sale or sharing of personal information (we do not sell personal information). To exercise any of these rights, contact us using the details below. We will not discriminate against you for exercising them.

If you are located in the European Economic Area or the United Kingdom, we process your information to perform a contract with you (such as an order), to pursue our legitimate business interests described above, or with your consent. Your information will be transferred to and processed in the United States.

Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including the security measures provided by Shopify and our payment processors. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Minors

The Site is intended for businesses and adults. We do not knowingly collect personal information from anyone under 18.

Changes

We may update this policy from time to time to reflect changes in our practices or for legal reasons. The date at the top shows when it was last revised.
